Acceptance of Terms
By accessing or using Buildrun's construction management platform ("Service") available at www.buildrun.app and our mobile applications, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our Service.
Description of Service
Buildrun provides a cloud-based construction management platform that includes project scheduling, task management, quality control, budget tracking, photo documentation, and reporting tools for real estate developers, construction companies, and PMC firms.
Account Registration
- You must provide accurate and complete information when creating an account
- You are responsible for maintaining the security of your account credentials
- You must be at least 18 years old to use our Service
- One person or entity may not maintain more than one account without prior approval
- You are responsible for all activities that occur under your account
Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws
- Attempt to gain unauthorized access to the Service or its related systems
- Interfere with or disrupt the integrity or performance of the Service
- Upload malicious code, viruses, or any harmful content
- Reverse engineer, decompile, or disassemble any part of the Service
- Use automated tools to scrape or extract data from the Service without authorization
- Resell, sublicense, or provide the Service to third parties without our written consent
Your Data
- You retain ownership of all data you upload to the Service ("Your Data")
- You grant us a limited license to process, store, and display Your Data as necessary to provide the Service
- You are responsible for the accuracy and legality of Your Data
- We may generate anonymized, aggregated analytics from usage patterns (not Your Data) to improve the Service
- Upon account termination, you may request export of Your Data within 30 days
Subscription and Payment
- Access to the Service requires a paid subscription as described on our pricing page
- Fees are billed according to your selected plan (monthly or annual)
- All fees are non-refundable unless otherwise stated in your subscription agreement
- We reserve the right to modify pricing with 30 days advance notice
- Failure to pay may result in suspension or termination of your account
Intellectual Property
The Service, including its design, features, code, documentation, and branding, is owned by Buildrun and protected by intellectual property laws. Nothing in these terms grants you any right to use our trademarks, logos, or brand features without prior written consent.
Service Availability
- We strive for high availability but do not guarantee uninterrupted access
- We may perform scheduled maintenance with reasonable advance notice
- We are not liable for any downtime, data loss, or service interruptions beyond our control
Limitation of Liability
To the maximum extent permitted by law, Buildrun shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Service.
Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.
Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be error-free, secure, or available at all times.
Indemnification
You agree to indemnify and hold Buildrun harmless from any claims, losses, or damages arising from your use of the Service, violation of these terms, or infringement of any third-party rights.
Termination
- Either party may terminate the subscription according to the terms of your plan
- We may suspend or terminate your account for violation of these terms
- Upon termination, your right to use the Service ceases immediately
- Sections on intellectual property, limitation of liability, and indemnification survive termination
Governing Law
These terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Gurgaon, Haryana, India.
Changes to Terms
We may update these Terms of Service from time to time. Material changes will be communicated through the Service or via email. Continued use after changes constitutes acceptance of the updated terms.
